Work Permit
Under Thai law, the foreign citizen must hold both working visa and work permit to involve in any form of business. Once entering Thailand with valid working visa, the foreign citizens could then apply for a work permit at designated branch of Department of Labour.
The application of work permit must be through an existing corporate, and it cannot be applied as an individual. Therefore, in order to obtain work permit, the foreign citizen must first find an employer in Thailand and follow the process accordingly.

For a company to apply for a work permit, the following must be fulfilled:
・The company must be a limited, public, or representative office format
・The company’s capital fund must be over 2 million THB per foreign employment
・Must have a valid VAT registration
・Capital fund must be fully proved

Documents Required for Application of Work Permit
Every document must have a signature and stamp of the company’s representative, and for the advance application, 3rd person must fill in the application form and attach a Thai ID card or a passport.

Work Permit FAQ
Q. Is it permitted to work for any company with a valid Work Permit and Working Visa?
A. Under “Foreign Capital Restriction” law, there is a restriction on the business which can involve the foreign citizens. Failing to obey so may result in maximum of 5 years imprisonment and/or 10,000 THB fine. If the business involves relation to Foreign Capital Restriction, it is important to consult professional advisors.

Q. With work permit obtained, is it possible to work at office other than the one stated on the work permit?
A. Under the law, it is illegal to operate or engage in a business at an address other than the one stated on the work permit. The relocation without notifying the Department of Labour may result is heavy penalty.
Q. The foreign representative currently does not possess a work permit. Is it possible for this person to be a guarantor for application of work permit?
A. If the representative is a foreign citizen and does not possess a work permit, that person cannot be the guarantor for the application of work permit. A part-time foreign advisor who does not possess a work permit is also not eligible to be a guarantor.
Q. When quitting a company, what happens to the work permit obtained from the company?
A. It is important to obtain a certificate to prove that the work permit has been returned to the company, as this certificate is required for the application for another work permit. If the company refuses to issue a proof, make sure to take a photocopy of the entire work permit for the record.
